Welcome to StreetwisePerks. These Terms of Service ("Terms") govern your access to and use of streetwiseperks.com and any related pages, checkout flows, and services (together, the "Site"), which is operated by [LEGAL ENTITY NAME] ("StreetwisePerks," "we," "us," or "our"). By browsing the Site, creating an account, placing an order, or submitting a sweepstakes entry, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who May Use the Site

You must be at least 18 years old and a legal resident of the United States or Canada to place an order, create an account, or participate in any sweepstakes on the Site. Some features may be unavailable in certain jurisdictions, and sweepstakes participation is void where prohibited by law. By using the Site, you confirm that you meet these requirements and that the information you give us is accurate.

2. What We Offer

StreetwisePerks sells apparel, accessories, and related merchandise, and runs periodic promotional sweepstakes. Merchandise purchases and entry packs may earn sweepstakes entries as described on the Site at the time of purchase. Sweepstakes are governed by our Official Rules (see Section 6).

3. Your Account

You may need an account to check out or to view your entries. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us right away at [CONTACT EMAIL] if you suspect unauthorized use. You may not create more than one account per person, and you may not share, sell, or transfer your account.

4. Orders, Pricing, and Payment

  • Pricing. Prices are shown in U.S. dollars unless stated otherwise. We may change prices, run promotions, or end promotions at any time. Promotional entry multipliers (for example, "5X entries") are limited-time and may change or end without notice.
  • Errors. If we discover a pricing, description, or entry-count error, we may correct it, cancel the affected order, and refund you in full.
  • Payment. Payments are processed by our third-party checkout and payment providers. By placing an order, you authorize the charge to your chosen payment method and confirm you are entitled to use it.
  • Taxes and shipping. Applicable taxes and shipping charges are calculated at checkout. Free-shipping thresholds, if offered, are shown in your cart.
  • Order acceptance. An order confirmation email is not a guarantee that we will accept the order. We may decline or cancel orders for suspected fraud, stock issues, pricing errors, or violations of these Terms.
  • Shipping, returns, and refunds. Our shipping and return practices are described in [LINK TO SHIPPING & RETURNS POLICY]. Where an order is refunded or canceled, any sweepstakes entries earned from that order are removed from your account.

5. Sweepstakes Entries: General Terms

  • Entries have no cash value, are not currency, cannot be sold, traded, or transferred, and expire when the applicable sweepstakes closes.
  • Entries earned through a purchase are credited to your account automatically after checkout. Crediting may take time, and we are not responsible for entries that are delayed, lost, or not credited because of technical issues outside our control.
  • Your odds of winning depend on the total number of eligible entries received in a given sweepstakes. No entry count, multiplier, or entry pack guarantees a win.

6. Official Rules Control the Sweepstakes

Each sweepstakes is governed by its own Official Rules, available at https://streetwiseperks.com/pages/official-rules. The Official Rules cover eligibility, entry periods, how to enter with and without a purchase, prize descriptions and values, odds, winner selection, and winner notification. If these Terms and the Official Rules conflict on a sweepstakes matter, the Official Rules control. On all other matters, these Terms control.

7. Winner Selection and Prize Claims

Winners are selected in a random drawing as described in the Official Rules and may be required to verify their identity and eligibility, complete an affidavit or release, and provide tax information before a prize is awarded. Winners are responsible for all taxes, fees, and expenses associated with a prize unless the Official Rules say otherwise. Prizes cannot be exchanged for cash unless the Official Rules say otherwise.

Prize scams. We will never ask a winner to pay a fee, send gift cards, or share login or verification codes in order to receive a prize. Winner contact will follow the method described in the Official Rules. If someone contacts you claiming to represent StreetwisePerks and asks for money or codes, do not respond, and report it to [CONTACT EMAIL].

8. Acceptable Use

You agree not to:

  • use bots, scripts, automated tools, or multiple accounts to enter or manipulate any sweepstakes or promotion;
  • provide false information or use someone else's payment method without permission;
  • attempt to gain unauthorized access to the Site, other accounts, or our systems;
  • interfere with the Site's security or operation, or introduce malware;
  • initiate chargebacks in bad faith or abuse our returns process;
  • copy, scrape, or resell Site content or products in violation of these Terms; or
  • use the Site for any unlawful purpose.

We may disqualify entries, void entries, cancel orders, suspend accounts, or withhold prizes where we reasonably believe these rules have been broken.

9. Intellectual Property

The Site and its content, including the StreetwisePerks name, logos, designs, graphics, product images, and text, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Site for personal, non-commercial purposes. You may not use our marks or content without our prior written permission.

10. Winner Publicity

Where permitted by law and as described in the Official Rules, a winner's name, city and state, and photo may be used by StreetwisePerks for announcements and promotional purposes without additional compensation. Winners will be asked for consent before their photo or likeness is published.

11. Third-Party Services

The Site relies on third-party services such as our e-commerce platform, payment processors, shipping carriers, and, where applicable, an independent sweepstakes administrator. We are not responsible for the acts, policies, or content of third parties, and your use of their services may be subject to their own terms. The Site may also link to third-party sites (such as social media pages) that we do not control.

12. Privacy

13. Disclaimers

The Site and all products, entries, and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, StreetwisePerks and its owners, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site or participation in any sweepstakes. Our total liability for any claim relating to the Site will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless StreetwisePerks and its owners, officers, employees, and partners from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

16. Suspension and Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Site or other users. You may stop using the Site at any time. Sections that by their nature should survive termination (including Sections 5 through 7 and 9 through 17) will survive.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at [CONTACT EMAIL] and give us 30 days to try to resolve the dispute informally. Changes to a sweepstakes' Official Rules will not apply retroactively to a sweepstakes already in progress unless required by law.

19. General

These Terms, together with the Official Rules and Privacy Policy, are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
